Terms & Conditions

  1. The return of this signed statement creates a binding agreement between Century 21 Scarborough (herein referred to as the “Agent”) and the tenant named in this booking.
  2. The property is let for holiday/short term purposes ONLY and only for the period stated on the registration form. NO weddings, parties or large gatherings are permitted without prior written approval. Any type of approved function or large gathering will incur a minimum bond of $3000.00.
  3. Full Bond (includes $100.00 cleaning fee) is required before keys can be collected. In addition rent shall be paid before occupancy, 50% payment is required immediately the booking is made and the balance must be finalised 14 days prior to arrival (except during the Peak Holiday Periods when 100% payment is required).  All card transactions (including EFTPOS) are accepted with a 3% surcharge, except AMEX which is 4%.
  4. Cash cleaning fees are refunded (conditions apply) in a cheque form via mail after seven working days.  If you require a receipt please enclose a self-addressed envelope when a payment is made. If a cheque is dishonoured or re-presented a fee will be payable. If using a credit or debit card for the security bond, it is pre-authorised but automatically released by the bank within 7- 10 working days.
  5. Any discrepancies and/or claims regarding the tenancy will result in written notification to you within fourteen days of your departure date.
  6. All damage, breakages or losses to the property and/or furniture and furnishings are to be reported within 24 hours. The tenant will be responsible for damage to the premises or loss of or damage to any items in the premises and the tenant will pay to the Agent the cost of replacement or repair (at the discretion of  the Agent) of any such item damaged or lost. $25.00 minimum charge applies.
  7. THE TENANTS UNDERSTAND AND ACCEPTS THAT ONCE PAYMENT IS MADE IT IS NON-REFUNDABLE. SHOULD A BOOKING BE CANCELLED FOR ANY REASON NO MONIES WILL BE REFUNDED AS THE AGENT TRANSFERS MONIES ON A REGULAR BASIS TO OWNERS. THE AGENT DOES NOT KEEP ANY PAYMENTS IN THEIR TRUST ACCOUNT FOR LONGER THAN 2 WEEKS, EXCEPT FOR BOND MONIES.
  8. If the property is sold, the Agent cannot accept responsibility for the decision made by the new owner(s). Every reasonable endeavour will be made to offer alternative accommodation should this occur.
  9. In the event that the said premises become unavailable for occupancy through unforeseen circumstances (fire, storm damage, change of ownership, etc) then the Agent will inform the tenant immediately and endeavour to obtain a suitable alternative premise for this tenancy; failing which any monies paid are to be refunded to the tenant.
  10. It is the tenant’s responsibility to take out travel insurance to cover any unforeseen circumstances. Also all care but no responsibility is taken for tenants’ personal property left on the premises.
  11. Rental Property keys are available for collection between 2pm and 5pm, Monday to Friday and Saturday between 11.00am and 12.00pm. Early arrivals can be arranged, providing property availability and ample prior notice is given. The Rental tenancy expires at 10am on date of departure. Keys must be returned on day of departure between 8.30am and 10.00am Monday to Friday and 8.30am and 10.00am Saturday. If vacating outside of these hours or on a Public holiday, please contact the office on the last working day before vacating. Failure to vacate before 10am or failure to notify the Agent of an early vacation, may incur a fee.
  12. Dishwasher cycle must be completed and dishwasher emptied, prior to departure.
  13. Excluding infants (under 12 months of age), the number of persons staying overnight at the property cannot exceed the total number of sleeping positions in the property.
  14. Where applicable Body Corporate Rules and Regulations shall be complied with.
  15. Noise is to be kept to a minimum. No person on the premises shall behave in a manner that is a nuisance to neighbouring occupants. Any persons causing nuisance or annoyance to surrounding residents will result in the immediate termination of the booking. The Agent cannot be held responsible or liable in any way for noise or disturbances created outside the property by local residents, workmen, etc., and no discounts will be negotiated.
  16. Fish and shellfish are to be opened and/or cleaned outside the premises only.
  17. Pets are NOT permitted on the premises without prior arrangement.
  18. The tenant SHALL NOT park cars on the premises or grassed areas, except in specific areas allocated for that purpose.
  19. No responsibility is taken by the property owner or the Agent for power failure resulting from the service provider failing to provide power for any reason whatsoever.
  20. No responsibility is taken by the property owner or Agent for misuse or failure of appliances during the rental tenancy for any reason whatsoever. All reasonable effort will be undertaken, by the Agent, to repair or replace any such items as soon as is practical. Please notify the Agent during your stay if any item requires maintenance.
  21. The tenant will permit the Agent and/or persons authorised by the Agent to enter the premises during the term for the purpose of necessary repairs and investigation of complaints. The Agent will give due regard to the tenants right to quiet enjoyment.
  22. Bookings are not transferable and (with telephone or internet bookings) the description and photographs of the property are made in good faith but no responsibility for mis-description can be accepted. Holiday Property Owners may replace, change or remove items without prior notice.
  23. Bookings are made in good faith by the Agent and tariffs quoted are correct at the time of printing and are subject to change without notice
